Seat Selection terms and conditions for Virgin Australia flights between Australia and Doha (VA1-29)
1. Application
1.1 These Seat Selection terms and conditions apply to your seat selection for Extra Leg Room seats, Exit Row seats, Preferred seats, or Standard seats (Seat Selection) on Virgin Australia flights between Australia and Doha, Qatar (VA1 – 29). These terms and conditions are in addition to Virgin Australia’s Conditions of Carriage, the Fare Rules and Privacy Policy, which you accept at the time you purchase a fare.
1.2 These Seat Selection terms and conditions are in addition to and do not vary the fare rules that apply to your fare.
1.3 To the extent of any inconsistency between these Seat Selection terms and conditions and the Conditions of Carriage, the Conditions of Carriage shall prevail.
2. Seat Selection
2.1. Seat Selection is available for purchase on Virgin Australia flights between Australia and Doha, Qatar (VA1-29) operated by Qatar Airways on behalf of Virgin Australia (Eligible Flights). When flying on an Economy Choice or Economy Reward fare, all Seat Selection options are available for purchase. When flying on an Economy Flex fare, all Seat Selection options are available to select free of charge.
2.2. Extra Leg Room seat selection allows guests flying on Economy Choice, Flex or Economy Reward fares on Eligible Flights to select an Economy seat that has additional leg room in an Extra Leg Room seating zone on their Eligible Flight (Extra Leg Room seat).
2.3. Exit Row seat selection allows guests flying on Economy Choice, Flex or Economy Reward fares on Eligible Flights to select an Economy seat in an emergency exit row on their Eligible Flight, if guests meet the Exit Row conditions set out in X below (Exit Row seat).
2.3.1 To be seated in an Exit Row seat, you must:
(a) be 18 years or older;
(b) be able to understand and acknowledge instructions printed on the Cabin Safety Card and able to follow the Cabin Crew directions in English during an emergency evacuation;
(c) Physically fit and strong without any medical condition, pregnancy, or impairment related to mobility, hearing, vision or mental health which may prevent you from performing the duties listed;
(d) not be travelling with an infant, children or assistance animals;
(e) not require the use of an extension seat belt
together, the Exit Row Conditions.
2.3.2. If you change your mind and no longer wish to sit in an Exit Row seat, or are unable to meet the Exit Row Conditions at time of travel, you may move to an Extra Leg Room seat outside of the exit rows for no additional fee. Please let us know as soon as possible if you no longer meet the Exit Row Conditions. If no other Extra Leg Room seat is available, you will be assigned a Standard seat and may request a refund of the Seat Selection fee in accordance with section 4.
2.4. Preferred seat selection allows guests flying on Economy Choice, Economy Reward or Flex fares on Eligible Flights to select an Economy seat in a Preferred seating zone on their Eligible Flight (Preferred seat). Availability and location of Preferred seats may vary by aircraft type.
2.5. Standard seat selection allows guests flying on Economy Choice, Flex or Economy Reward fares on Eligible Flights to select an Economy seat in a Standard seating zone on their Eligible Flight (Standard seat).
2.6. Seats will be classified as the type of seat on the seating map on the Virgin Australia website, which is made available when making a booking or through Manage Your Booking after the booking has been made.
2.7. Seats may or may not be able to recline.
2.8. Guests may be able to select or purchase Seat Selection that allows a bassinet to be attached to a seat. Bassinets, and seating which allows bassinets, are subject to availability.
2.9. Seat Selection will become complimentary for all remaining available seats when checking in at the airport within two hours of the Eligible Flight’s scheduled departure. Guests who do not select their seat prior to check in will be allocated a seat.
2.10. Velocity Platinum and Gold members and up to 8 additional companions travelling on the same booking, travelling on Economy Choice, Flex or Economy Reward fares, may select a Standard seat, Preferred seat or Extra Leg Room seat without charge if available at the time of the request. These seats will not be automatically assigned to Velocity Platinum and Gold members.
3. Purchasing and making changes to Seat Selection
3.1. Seats are subject to availability and may be sold out at the time of booking or at any time prior to your travel date.
3.2. Virgin Australia may change its published prices for Seat Selection at any time. The applicable Seat Selection price will be the price published at the time you purchase Seat Selection. Prices are per person, and per sector. Prices may vary by sale channel due to system functionality. Prices are in the applicable booking currency, being the country of origin specified in your booking or purchase.
3.3. Velocity members will not earn Velocity Points or Status Credits on the amount paid for Seat Selection.
3.4. If you choose to change your booking from a direct flight to multiple connecting flights, you will need to pay an additional Preferred Seat selection fee for each additional sector (if applicable). This additional fee will be payable at the time of the change.
3.5. Seat Selection fees are non-transferrable (to other passengers) and cannot be used towards any other service or product.
3.6. You may be able to change the seat that you have selected after purchasing Seat Selection up to 180 minutes before your scheduled flight departure, subject to availability of other seats. You can request a change to your selected seat at the airport or by calling the Guest Contact Centre.
3.7. We will endeavour to accommodate your selected seat. However, we cannot guarantee you will be seated in the seat you have selected. We may change your seat at any time, even after you have boarded the aircraft for any reason, including for safety or operational reasons. If this happens, you may be entitled to request a refund of any fees paid for Seat Selection, see section 4.
4. Refunds and your rights
4.1. This section 4 outlines when we will provide you with a refund of the Seat Selection fee you have paid under these terms and conditions. There may be additional circumstances where you are entitled to a refund of the Seat Selection fee under the Australian Consumer Law. 4.2. In the event Virgin Australia re-accommodates you onto another flight, for any reason other than the Guest’s act or omission, Virgin Australia will use reasonable endeavours to transfer you to a seat that you had purchased Seat Selection for, on the new flight. The transfer of seats in these circumstances is subject to availability.
4.3. If we do not provide you with a seat that you purchased Seat Selection for, you are entitled to request a refund of the Seat Selection fee, for that specific part of the journey, if:
(a) you were rebooked to another flight:
(i) by Virgin Australia for reasons within its control (as set out in clause 8 of our Guest Compensation Policy);
(ii) because you missed your connecting Virgin Australia flight after an inbound flight on Virgin Australia or its codeshare partners and you were not provided with a comparable seat to the seat you purchased Seat Selection for on the other flight;
(b) Virgin Australia cancelled your flight and you were unable to be reaccommodated on another flight;
(c) we changed the aircraft operating your flight and there were no seats that you had purchased Seat Selection for available on the alternative aircraft;
(d) we used our right to assign or reassign your selected seat either before or after boarding for operational, safety, security or other reasons, and you were not provided with another like-for-like seat. “Like-for-like” being another seat of the same type that you purchased Seat Selection for, in the same position (i.e. window, middle or aisle) within the seating zone either in the row directly in front, or directly behind your original selected seat);
(d) we reaccommodated you and you are moved to a new seat that is not like-for-like with the same type that you purchased Seat Selection for (“like-for-like" being another seat which is the same seat type (window, middle or aisle) within the relevant seating zone in the two rows in front of or behind your original selected seat);
(e) we changed your seat either before or after boarding, and you were not provided with another like-for-like seat as the seat you purchased Seat Selection for (“like-for-like" being another seat which is the same seat type (window, middle or aisle) within the relevant seating zone in the two rows in front of or behind your original selected seat);
(e) for Exit Row seats, you were seated in an exit row, however were assigned a Preferred seat or Standard seat because you no longer wanted to sit in an Exit Row seat or no longer meet the Exit Row Conditions, and we were unable to accommodate you in an Extra Leg Room seat; or
(f) if you request a flight change in the Manage Your Booking section on Virgin Australia’s website and you do not re-select the same type of seat that you purchased Seat Selection for in your updated booking.
(f) you purchase an upgrade to another class of travel, including UpgradeMe Premium Bid and UpgradeMe Points.
4.4. To the extent permitted by law, Seat Selection fees will not be refunded if the following occurs:
(a) If you have purchased Seat Selection and you choose to change or cancel your booking;
(b) we offer you a complimentary upgrade to a higher class of travel and you accept that offer; and
(c) if Virgin Australia changes or cancels your flight, and reaccommodates you on another flight which you accept, and cannot provide the seat you have selected, but can provide a like-for-like seat (“like-for-like" being another seat of the same type that you purchased Seat Selection for, in the same position (i.e. window, middle or aisle) within the relevant seating zone in the two rows in front of or behind your original selected seat).
4.5. Refunds can be requested through the General Enquiries form on the Virgin Australia website. If we agree that you are entitled to a refund, the Seat Selection fee will be refunded to the original form of payment.
5. General
5.1. You have certain rights under the Australian Consumer Law. These include Consumer Guarantees that the services we provide to you will be carried out by us with due care and skill, will be fit for purpose and will be supplied within a reasonable time. You may have rights to seek a remedy from us where we fail to provide services to you in accordance with the Australian Consumer Law. Nothing in these terms and conditions affects those rights or any other statutory rights you may have under applicable laws (including the Australian Consumer Law) that cannot be excluded.
5.2. Virgin Australia may modify and change these terms and conditions from time to time. The terms and conditions which apply to your purchase of Seat Selection are those in effect at the date of purchase, as published on our website.
5.3. The failure by Virgin Australia to exercise its rights will not be construed as a waiver or relinquishment of the future performance of any of its rights, and the Guest’s obligations with respect to such future performance shall continue in full force and effect.
